These terms are available in English. Norwegian users may request a Norwegian translation by contacting us.

These Terms of Service ("Terms") govern your access to and use of ARTdeck ("the Service", "we", "us", or "our"), a portfolio builder platform operated by Bizziprops. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must meet the following criteria to use the Service:

  • Be at least 13 years old (or 16 in the European Economic Area)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete registration information
2. Account Registration and Security

2.1 Account Creation

  • You must provide a valid email address and create a unique username
  • Each username is unique and available on a first-come, first-served basis
  • You are responsible for maintaining the confidentiality of your password
  • You may not impersonate others or use offensive usernames

2.2 Account Security

You are responsible for all activities under your account. Notify us immediately at artdeck@bizziprops.no if you suspect unauthorized access.

2.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service.

3. Subscription Plans and Billing

3.1 Free and Paid Plans

  • Free Plan: Limited features and storage as specified on the pricing page
  • Starter Plan: Basic paid features with moderate limits
  • Pro Plan: Enhanced features with increased limits
  • Advanced Plan: Maximum features and storage

3.2 Billing and Payments

  • Paid subscriptions are billed monthly or annually in advance
  • All prices are in Norwegian Kroner (NOK) and include Norwegian VAT (moms) where applicable
  • Payments are processed securely by Stripe (we do not store credit card information)
  • Fees are non-refundable except: (1) as required by Norwegian consumer law, (2) for service failures lasting more than 7 consecutive days, or (3) where we cannot deliver the contracted service
  • Failed Payments: If a payment fails, we will attempt to charge your payment method up to 3 times over 7 days. If all attempts fail, your subscription will be suspended until payment is resolved

3.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • No partial refunds for unused time within a billing period
  • Downgrading to a free plan retains your data within free tier limits

3.4 Price Changes

We may change subscription prices with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

3.5 Right of Withdrawal (EEA Consumers)

If you are a consumer in the European Economic Area (EEA), you have the right to withdraw from your subscription within 14 days of purchase without giving any reason, in accordance with EU Directive 2011/83/EU.

Important: By subscribing to a paid plan and immediately accessing premium features, you expressly request that we begin providing the Service immediately and acknowledge that you will lose your right of withdrawal once the Service has been fully performed.

To exercise your right of withdrawal (if applicable), contact us at artdeck@bizziprops.no within 14 days of your subscription purchase.

4. User Content and Ownership

4.1 Your Content

You retain all ownership rights to content you create, upload, or publish through the Service, including text, images, projects, and portfolio information ("User Content").

4.2 License to Us

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store, host, and display your User Content
  • Make your published portfolio publicly accessible on the internet
  • Process your content to provide the Service (e.g., image optimization)

This license ends when you delete your content or close your account, except for content that has been shared or published publicly.

4.3 Content Restrictions

You agree NOT to upload or publish content that:

  • Violates intellectual property rights or privacy rights of others
  • Contains malware, viruses, or harmful code
  • Is illegal, defamatory, harassing, or discriminatory
  • Promotes violence, illegal activities, or hate speech
  • Includes pornographic or sexually explicit material
  • Violates any applicable laws or regulations

4.4 Content Moderation and Reporting

We reserve the right to remove content that violates these Terms without prior notice. Repeated violations may result in account termination.

Reporting Violations: If you believe that content on the Service violates intellectual property rights, contains illegal material, or violates these Terms, please report it to artdeck@bizziprops.no. Include the portfolio URL, description of the violation, and any supporting evidence.

Response Times: We will acknowledge reports within 7 business days and investigate thoroughly. Illegal content (child exploitation, terrorism, etc.) will be removed within 24 hours. Other violations will be addressed within 14 days of acknowledgment.

5. Acceptable Use Policy

You agree NOT to:

  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers/networks
  • Use automated tools to scrape, harvest, or collect data from the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Resell, sublicense, or redistribute the Service without permission
  • Use the Service for illegal purposes or to violate others' rights
  • Overload or attempt to disable the Service (e.g., DDoS attacks)
6. Intellectual Property Rights

The Service, including its design, features, code, and content (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from the Service without our written permission.

"ARTdeck" and our logos are trademarks. You may not use them without permission.

7. Service Availability and Maintenance

Service Level: We target 99.9% monthly uptime (excluding scheduled maintenance). Scheduled maintenance will be announced in advance when possible.

  • We may suspend the Service temporarily for planned upgrades, security patches, repairs, or emergency maintenance
  • Admins may access the platform during maintenance mode. Regular users will see a maintenance notice
  • We are not liable for brief service interruptions (less than 24 hours) due to maintenance or circumstances beyond our control

Service Credits for Extended Outages:

For paid subscribers experiencing more than 24 consecutive hours of downtime due to our fault (not including scheduled maintenance or force majeure), please contact artdeck@bizziprops.no for service credits or pro-rated refunds.

8. Data Backups

While we perform regular backups, you are responsible for maintaining copies of your content. We recommend exporting your portfolio data periodically.

We are not liable for data loss due to user error, service failures, or other causes.

9. Third-Party Services

The Service integrates with third-party services:

  • Stripe: Payment processing
  • Google OAuth: Authentication (optional)
  • Supabase: Infrastructure and database

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Limitation of Liability

We are liable for damages caused by our negligence or intentional acts. Our liability is limited to direct damages up to the amount you paid in the past 12 months (for paid subscribers) or NOK 5,000 (for free accounts), except where Norwegian law prohibits such limitations.

We are not liable for:

  • Indirect or consequential damages (such as lost profits or data loss)
  • Service interruptions due to scheduled maintenance or circumstances beyond our control
  • Actions or failures of third-party services (Stripe, Google OAuth, Supabase)
  • User error, account security breaches caused by user negligence, or unauthorized access to your account

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Norwegian Consumer Rights:

These limitations do not affect your rights under Norwegian mandatory consumer protection laws (Forbrukerkjøpsloven). We remain fully liable for gross negligence, intentional harm, personal injury, defective service delivery, or violations of your consumer rights.

11. Indemnification (Business Users Only)

If you use ARTdeck for commercial or business purposes, you agree to indemnify, defend, and hold us harmless from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from:

  • Your User Content or portfolio materials
  • Violation of these Terms or applicable laws and regulations
  • Violation of any third-party rights (intellectual property, privacy, publicity)
  • Claims by third parties related to your use of the Service

Consumer Accounts:

This indemnification clause does not apply to consumer accounts used for personal, non-commercial purposes. Norwegian consumer protection laws (Forbrukerkjøpsloven) take precedence for consumer users.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

12.2 Dispute Resolution

Before filing a claim, you agree to contact us at artdeck@bizziprops.no to attempt informal resolution.

12.3 Jurisdiction

For business users and users outside Norway, disputes shall be subject to Oslo tingrett (Oslo District Court). Norwegian consumers may bring claims in their local district court (tingrett) as provided by Tvisteloven (Dispute Act).

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Updating the "Last Updated" date
  • Posting a notice on the Service
  • Sending an email to your registered email address (for material changes)

Your continued use after changes constitutes acceptance. If you disagree, stop using the Service.

14. Termination

14.1 By You

You may close your account at any time through account settings. Upon closure:

  • Your portfolio will be unpublished and inaccessible
  • Data will be soft-deleted and retained for 30 days
  • After 30 days, data is permanently deleted

14.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay, or engage in fraudulent activity. We will provide notice when possible.

14.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that should survive termination (e.g., liability limitations, indemnification) remain in effect.

15. General Provisions
  • Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • Waiver: Failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms; we may assign them with notice
  • Force Majeure: We are not liable for delays or failures beyond our reasonable control
